EB-2 NIW Requirements: Who Qualifies and What to Prove

By MyAutoform Team 5 min read

The EB-2 National Interest Waiver lets you self-petition for a green card without a job offer. Here are the two layers of requirements — EB-2 eligibility and the three Dhanasar prongs — and the evidence that supports each.

The EB-2 National Interest Waiver (NIW) is one of the few paths to a U.S. green card that does not need an employer or a job offer. You can file the petition yourself. But "no sponsor" does not mean "no requirements": USCIS checks two separate layers, and a petition has to clear both.

Layer 1: You must qualify for the EB-2 category

Before the waiver is even considered, you must fit EB-2 in one of two ways:

  • Advanced degree — a U.S. master's degree or higher (or a foreign equivalent), or a bachelor's degree followed by at least five years of progressive experience in the field.

  • Exceptional ability — expertise significantly above what is ordinarily found in sciences, arts or business, shown by at least three of six criteria: an academic record in the field, letters documenting ten years of experience, a professional license, a salary showing exceptional ability, membership in professional associations, and recognition for achievements from peers, government or professional organizations.

Foreign degrees usually need a credential evaluation showing the U.S. equivalent.

Layer 2: The three Dhanasar prongs

Since Matter of Dhanasar (2016), USCIS grants the waiver when the petitioner shows all three of the following:

1. Your proposed endeavor has substantial merit and national importance

You describe the specific work you plan to do in the United States. Merit can be in business, science, health, education, culture and more. National importance looks at the broader impact — for example economic effects, jobs, public health or advances in a field — not just the value to one employer or client.

2. You are well positioned to advance that endeavor

USCIS looks at your education, skills, track record, a plan for the work, progress already made and interest from potential users, clients, investors or partners.

3. On balance, waiving the job offer and labor certification benefits the United States

You explain why the country gains by letting you proceed without the normal labor certification process — for example because the work is urgent, because you are self-employed, or because your contribution matters beyond a single job.

Evidence that usually supports an NIW petition

  • A detailed CV or résumé

  • Diplomas, transcripts and a credential evaluation

  • A clear statement of the proposed endeavor

  • Recommendation letters from independent experts who know your work

  • Publications, citations, patents, awards, media coverage or contracts, when relevant

  • A business plan, when the endeavor is a company

How the filing works

The petition is filed on Form I-140 with the supporting evidence and a cover letter that ties each document to the requirements above. There is no PERM labor certification step. Premium processing is available for NIW petitions for an extra fee. Government fees are paid to USCIS and change over time — always confirm the current amounts on the official USCIS fee page before filing.

Start by checking your profile

The fastest way to see where you stand is to compare your background with the two layers above. Our free CV review reads your résumé and points out which EB-2 criteria and Dhanasar prongs your profile already supports — no account needed. When you are ready to build the case, the EB-2 NIW package walks you through a guided interview and prepares the forms, letters and memorial from your answers.
